Terms and Conditions is a health and wellness on-line platform (the “Platform”) operated by MUSC Health, the clinical enterprise of the Medical University of South Carolina, an agency of the State of South Carolina (“MUSC”). MUSC Health is comprised of MUSC and certain of its affiliates (collectively, the “MUSC Parties,” and herein also referred to as “We,” “Our,” or “Us”).

These terms and conditions (the “Terms”) apply to your use of the Platform. By using the Platform, you agree to these Terms; if you do not agree to these Terms, your sole remedy is to not use the Platform. MUSC Health reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms, at any time.

Information accessed through this site is provided “AS IS” and without warranty, express or implied. All implied warranties of merchantability and fitness for a particular purpose are hereby excluded. Except as otherwise expressly specified, the MUSC Parties do not warrant the accuracy, completeness or correctness, timeliness, or usefulness of any services, merchandise or other information provided through the service or the Platform and in no event will the MUSC Parties be liable to you or anyone else for any decision made or action taken by you or anyone else in reliance upon the information provided through the service or the Platform.

While is intended to advance MUSC’s tripartite mission of patient care, education and research, the MUSC Parties do not endorse any party offering services on the Platform (the “Participants”). Each of the Participants is acting as an independent contractor and is solely responsible for any services it offers via the Platform or otherwise. Except for its own provision of services to Platform users and as limited by any terms of such service, no MUSC Party shall have any liability (whether in contract, tort, negligence, strict liability in tort, or by statute or otherwise) to you concerning performance or non‑performance by Participants of services herein described. Furthermore, except for its own provision of services to Platform users and as limited by any terms of such service, no MUSC Party shall have any liability (whether in contract, tort, negligence, strict liability in tort, or by statute or otherwise) to any third party concerning performance or non‑performance by Participants of services herein described, or in any manner related to the Platform. Your exclusive remedy for any claim arising out of these arrangements shall be solely against the Participant who provided (or failed to provide) the selected services. In any event, the liability of any of the MUSC Parties hereunder is subject to the limitations set forth in Section 33-56-180 and/or Section 15-78-120 of the South Carolina Code. In no event shall any of the MUSC Parties nor any Participant be liable for any consequential, indirect, special, incidental or punitive loss, damage or expenses (including but not limited to lost profits, savings, data, or the cost of recreating lost data), even if advised of their possible existence. Any action by a complainant must be brought within one (1) year after the cause of action arose. The allocations of liability in this paragraph represent the agreed and bargained‑for understanding of the parties and are an express condition of use of the Platform.
